1. Acceptance of these Terms
These Terms of Service ("Terms") govern your use of Hunch (the "App"), made available by Philipp Tschauner ("we", "us", "our"). By downloading, installing, or using Hunch, you agree to these Terms. If you do not agree, please do not use the App.
2. The Service
Hunch is described as: "One pick. No lists. Your taste, out loud." It is one of six small, independently built apps released under the Paperplanes club by a single solo developer. Features may change, be added, or be removed over time as the app is refined.
3. License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use Hunch on devices you own or control, strictly in accordance with these Terms and Apple's Usage Rules set out in the App Store Terms of Service.
4. In-App Purchases & Subscriptions
Where Hunch offers in-app purchases or subscriptions, these are billed and managed entirely by Apple through the App Store. Refunds, billing disputes, and cancellations are handled by Apple in accordance with Apple's own terms — we do not process payments directly and cannot issue refunds ourselves.
5. Acceptable Use
You agree not to misuse the App — including attempting to reverse-engineer it, interfere with its normal operation, or use it for any unlawful purpose. Any content you create or input within the App remains yours; we do not claim ownership over it.
6. Third-Party Services
The App may rely on third-party infrastructure (such as Apple's App Store, push notification, and CloudKit services, or hosting/analytics providers) to function. We are not responsible for the availability or behavior of services we do not control.
7. Disclaimer of Warranties
Hunch is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by applicable law.
8. Limitation of Liability
To the extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the App. Nothing in these Terms limits liability that cannot be excluded under applicable law.
9. Termination
You may stop using the App at any time by deleting it. We may suspend or discontinue the App, in whole or in part, at any time — for example if it is retired or replaced by a future version.
10. Changes to these Terms
We may update these Terms from time to time as the App evolves. Continued use of the App after an update constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of Germany, without regard to conflict-of-law principles. Where mandatory consumer-protection law in your country of residence grants you additional rights, those rights remain unaffected.
